FMLA Guidelines For Employers

The Family & Medical Leave Act is a federal law that applies to employer organizations with 50 or more employees for 20 or more workweeks in the current or previous calendar year.

The FMLA does not take the place of other sources of leave, including state leave laws. To the extent an organization subject to the FMLA is also subject to a state leave law, it must comply with both the FMLA and the state leave law.

The challenge in coordinating compliance with federal and state law is that the state leave laws differ from the FMLA in any of a variety of ways including the following:
  • The state leave law may have different requirements for what employers are subject to it than the employer requirements under FMLA
  • The state leave law may have different employee eligibility criteria than the FMLA (i.e., a given employee may be eligible for leave under one law but not the other, or eligible for leave under both laws)
  • Some types of leave may be protected under the FMLA, but not the state leave law; the state leave law may protect some types of leave that are not protected under the FMLA; and some types of leave may be protected under both laws
  • Even for those types of leave protected under both state and federal law, the leave protections may differ (e.g., duration, benefits protection, job restoration, etc.). For example, the length of a state leave may be 16 weeks versus 12 weeks under the FMLA
