The Employee Retirement Income Security Act of 1974 ("ERISA") imposes fiduciary duties on persons involved with employer-sponsored retirement and health and welfare plans, including those persons who have discretionary responsibility in the administration of such plans.
Some courts have referred to ERISA's fiduciary standards as the highest known to the law, and fiduciaries can be held personally liable for breaching their duties.
If you are involved with an employee benefit plan subject to ERISA, it is critical that you know when you are acting in a fiduciary capacity and, if so, with what standards you must comply.

He advises clients regarding fiduciary compliance, service provider arrangements, and various other issues relating to the design, management, and administration of employee benefit plans.
He also advises clients regarding matters initiated by the United States Department of Labor, Employee Benefits Security Administration, and represents clients involved in ERISA litigation.
In 2012, Mr. Garofolo was selected by California Lawyer magazine as a recipient of the California Lawyer Attorneys of the Year (CLAY) Award in the field of employee benefits. CLAY Awards honor California attorneys who have profoundly impacted the law.
