Take for example the recent workplace shooting in June, which left 6 dead including the shooter in a San Francisco UPS facility. Or, the shooting in the same month which left 5 dead in Orlando after a disgruntled employee came into the office with a weapon and singled out his victims. Across the US active shooter incidents are occurring with chilling popularity.

The Department of Homeland Security (DHS) defines an active shooter as an individual(s) actively engaged in killing or attempting to kill people in a confined and populated area. The DHS’ recommendation to address potential active shooter scenarios is advance preparation and training by developing a workplace violence and active shooter emergency action plan, and successfully training employees on that plan. This preparation is a critical element for successfully avoiding massive active shooter incidents and the death tolls they rack up.

Tracy L. Moon, Jr. is a partner in the Atlanta office of Fisher Phillips LLP. He represents employers in all aspects of labor and employment law. His experience includes representation of employers before state and federal trial and appellate courts in matters under Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, Americans With Disabilities Act, Family and Medical Leave Act, and a variety of state law wrongful discharge, contract and tort claims. He also represents of employers before the National Labor Relations Board and other government agencies, including the EEOC and OSHA.
