The ADA Amendments Act just made managing your ADA responsibilities tougher by substantially changing certain compliance requirements.
Specifically, the law broadened the list of Major Life Activities re "major bodily functions", creating a way for employees to game the system. In fact, it's been reported that some dishonest employees are asking their doctors to write out, specifically, what they want as an accommodation!
Here are some examples:..."What do you mean I have to grant her time off as an "accommodation" for her to go get Invitro Fertilization treatments????!"
..."Are you serious…I have to give him a day-shift schedule as an "accommodation" for his Irritable Bowel Syndrome?"
..."Are you kidding? I have to tell my employees who work rotating shifts that Fred doesn't have to? How am I supposed to explain THAT without a mutiny on my hands? I can't disclose that Fred has depression and that allowing him to work a dayshift schedule is an ADA accommodation. Ugh! This is becoming a nightmare!" ...and these are just a few of the nice comments!

- How to determine if an employee has a qualified disability - and how to document appropriately
- The specific challenges when handling issues involving mental disabilities such as Bipolar Affective Disorder, Post Traumatic Stress Syndrome, Depression, and others
- The balancing act of providing reasonable accommodations while also handling the "sticky issues" such as declining employee performance, absenteeism, and unreasonable requests
