H-2B Visas: What You Must Know To Comply With The DOL's New Rule Before The April 23 Deadline
|Date / Time:
The Department of Labor's H-2B program is designed to help businesses staff positions when there is a temporary shortage of U.S. workers available to perform certain jobs. The program lets foreign workers enter the United States on a temporary basis when qualified domestic workers are not available - as long as the wages and working conditions of U.S. workers are not compromised.
On April 23, 2012, the DOL is issuing a new final rule on H-2B visas that will make these jobs more accessible to U.S. workers and provide stronger protections for every worker while providing employers greater flexibility and certainty throughout the application and recruitment processes. The final rule will create a national registry for all H-2B job postings, increase the amount of time during which U.S. workers must be recruited, require the rehiring of former employees when available, and much more.
The final H-2B visa rule brings with it potential legal challenges and a whole host of new compliance obligations for employers, so it's vital for you to have a solid understanding of the rule's components before the April compliance deadline.
