FMLA, ADA And Workers' Comp Overlap: Overcoming New Compliance Challenges
|Date / Time:
Let's say you've got a pregnant employee who experiences complications. She's entitled to FMLA leave because her condition is serious enough to be protected. But is she also entitled to leave as an accommodation under the ADA? And if so, how much leave is she entitled to in total?
And what about when an employee claims workers' comp and is unable to return to work, with or without accommodation, for several months? What are your options?
Complicated issues like these arise all the time when the line separating employee FMLA rights, applicable workers' comp coverage, and their rights under the ADA isn't always clear. Employer rights and obligations can get murky, and it's imperative that you know how to determine precisely what you can and can't do when facing the treacherous triangle of disability and leave laws.
Participate in this interactive webinar, and you'll learn:
- When a serious health condition generally translates as "substantially limiting" an employee in the performance of a major life activity under the ADA
- What you should do to determine if an employee should be granted more time off once FMLA leave expires
- Whether you should consider reassigning a disabled employee to a vacant position for which he is qualified as a reasonable accommodation
- Real-life scenarios highlighting the interaction between the ADA, FMLA, and workers' comp
- Signs that your existing leave policies and practices could likely spark failure-to-accommodate claims against your organization
- When additional time off as an accommodation may present an undue hardship for your organization - and tips on how to handle this type of situation
- Best practices for terminating an employee protected under federal disability and leave laws, including a checklist of steps to take before taking any adverse employment action
In just 90 minutes, you'll learn what you must do to keep your organization in compliance with the latest ADA, FMLA, and workers' comp rules and regulations. Register now risk-free.

|About Webcasts / Audio Conferences / Podcasts:|
Webcasts, audio conferences, and podcasts are presentations that you
attend via the Internet, phone, or mobile device at a specified date and time for "live" versions, or at your convenience for "recorded" and "On-Demand" versions.
versions are interactive, meaning that participants can ask questions in real time, plus are a very cost-effective form of training because 1) you receive fast, convenient learning without
any out-of-office time; 2) you can invite as many colleagues as you'd like to listen in on a single phone line; 3) you incur no travel expenses; and 4) you and your colleagues are back
at work immediately after the session ends!
And though with recorded versions you do lose the ability to ask questions, you gain the ability to hear the presentation numerous
times and to share it with others in your office.
Handout materials and the phone number for live presentations are made available to you prior to the event via email from the
presenter and from the "MyAccount" link on the menu bar. Copies of the presentations are included with recorded versions.
