In March 2013, the Department of Health and Human Services' Office of Civil Rights issued a comprehensive rule to the privacy, security, enforcement, and breach notification rules for HIPAA. On September 23, 2013, all covered entities must comply with most of the rule's provisions.
In addition to making "business associates" themselves liable for compliance, the rule also means beefed up HIPAA penalties for non-compliance. For instance, an organization could be hit with a $50,000 per-violation fine capping out at $1.5 million for identical violations. Keep in mind that the fines may be stacked for various types of violations, which could result in maximum penalties much higher than the annual cap.
