2015 ushers in an unprecedented number of new obligations for federal contractors, ranging from self-identification for disabled applicants to new guidelines for pregnant employees – each raising the prospect of new and more numerous accommodation requests.
In addition to understanding the breadth and nature of the accommodations required, contractors must also observe criminal background check criteria and assure non-discrimination for protected applicants and employees so they can avoid Equal Employment Opportunity Commission (EEOC) scrutiny.

- What courts consider a “reasonable accommodation” — and, if you don’t have the capacity to provide an accommodation, how to demonstrate that it poses an undue hardship
- What creates the employer’s obligation to interact with employees about reasonable accommodation — and what that interaction must include
- What accommodations you must provide—examples such as additional leave, modified duties, reassignment, a modified work schedule, or a transfer will be discussed
Burton J. Fishman, Of Counsel with Fortney & Scott LLC, has devoted his practice to developing the “law of the workplace,” an interdisciplinary approach that offers employers counsel and representation on a broad range of matters growing out of government regulation of business, focusing on OFCCP and ADA issues. Mr. Fishman served as the Deputy Solicitor for National Operations for the U.S. Department of Labor during the George H. W. Bush Administration. He also is a widely recognized author of over 100 books and articles on workplace issues.
Leslie E. Silverman, a shareholder with Fortney & Scott LLC, is a nationally recognized employment attorney. She served as the Vice Chair and Member of the U.S. Equal Employment Opportunity Commission, and Labor Counsel to the U.S. Senate Health, Education, Labor and Pensions Committee. Ms. Silverman counsels and advises clients on complying with workplace laws, dealing with the EEOC, other government agencies and Congress, and on a wide range of workplace issues, including employment screening and diversity and recruitment and retention programs. Ms. Silverman also conducts workplace investigations and represents clients before the EEOC and other government agencies.
