Notice Requirements For Employees Requesting FMLA Intermittent Leave
5/14/2026
Employees must provide 30 days' notice if the need is foreseeable (e.g., scheduled treatments) under FMLA.
If not foreseeable, notice must be given as soon as practicable (usually same or next business day). For an HR Generalist, documenting these timelines is a critical part of human resources compliance.
Must follow employer's usual call-in procedures in accordance with labor law, unless it's impossible due to medical circumstances. Any medical information shared during this process must be handled per HIPAA privacy standards and ADA requirements. Note: This is an excerpt from our FMLA Training & Certification Program.
